I have received a complaint that work has just commenced at the above site. Although all conditions on the NOD have been discharged I am trying to establish that development actually commenced within 3 years of the date of permission which was 26 September 2007.
I note that an initial notice was notified to ERYC Building Control on 3 September 2010, within the 3 year period.
As you are aware development on this site should have commenced within the 3 year period for a lawful start to have been made. I would be grateful, therefore, if you could detail what work has been carried out prior to 26 September 2010 that would amount to a lawful start.
